We would like to understand that if we want to invest funds now in Phillipines then whether the general policies and specific guidelines of year 2007 will apply or 2006 or both. Actually we are looking for shifting our existing machinery from India and pursuant to Investment Priorities Plan 2006 minimum investment for the purpose is required US$ 5 Million whereas Investment Priorities Plan 2007 is silent about the requirement. Please help in establishing the opinion.

can i ask about credit card companies. are they allowed to give such high interests and penalties? can a person asked for a condonation of interests? what happens if a person cannot pay his credit card anymore?

good day! your website si very interesting...i learned a lot and want to learn more. I want to know if the lessee have an unsettled account with the lessor, and they left fixtures (aircon) and furnitures intentionally, do the lessor have the right to use the said fixtures and furnitures or do the lessor have the right to dispose them? what if the lessee comes back after 5 months and claim for those and the lessor is already using it, is the lessor obligated to return them? what happened to the unsettled accounts with the rentals? what about the damages in the building left by the lessee, what case do we need to file? Please clarify. thank you so much.

Dear Sir,
I encountered an interesting issue and want to have your opinion about this. Are a Diplomatic Mission is immune from any labor suit, are they exempted totally on the Philippine domestic laws, such as non payment of basic salary, deduction of monthly salary, forcing employee to resign with out paying of separation pays. Are they really such powerful and mighty?

i was hired by an employment agency as a general clerk for an international financial institution in its headquarter here in manila. the institution enjoys immunity from philippine laws, but, although it observes only our legal holidays as a non-working days. however, the employment agency never paid us any holiday pays, be it legal or special, invoking the principal's immunity from local laws. are contractual employees, whose work assignment is with an international institution that enjoys immunity, entitled for a holiday pay? can the employment agency invoke the principal's immunity on not giving holiday pay of its contractual employees? please clarify. many thanks

Our firm was given Right-of-Way by the govt for the rehabilitation of a certain highway at Southern Tagalog. A corporation whose property is traversed by the highway demanded that we construct a ramp to connect their lot to the new highway. Their property will be 1 meter lower when the construction is completed. Is their demand tenable? Can we ignore their demand? can you cite specific provisions of the law that governs the said issue. Hi Atty. Can you please send me a link on how to know the legalities on a warrantless arrest. Example for an entrapment, can everyone at the place of entrapment can be arrested without any warrant and will be detained? What is the person is not inside the place of the entrapment and just entered the office after the entrapment, can that person be arrested without any warrant also? Please send me an email as I am really worried about this and until now I do not have any lawyers yet as I cannot afford the acceptance fee they are asking

sir. if I choose "refusal with action for damages" under article 1599 3rd paragraph of the civil code of the Phil, in case of breach of warranty against eviction by the seller then what would be the instances under this to defend my side in a debate scenario?

What does "...by a notarial act" in Sec. 4 of RA No. 6552 mean? Does this mean that I will insert an "Acknowledgement" portion in my letter to the defaulting installment buyer of my real property? If not, is there an appropriate legal form for the Notice of Cancellation or Rescission of Contract as enunciated in RA 6552?

I am the daughter of Gloria Bongalon Colasito, one of the heirs of the property that is being mentioned on this case. My grandparents names - Cirila Bonga and Bernabe Bongalon, This case mentions the other 4 children which are Eleuteria Bongalon (deceased), Gloria Bongalon Colasito, my mother, (deceased), Anastacio Bongalon (deceased recently) and Jose Bongalon who is still alive.

Me my first cousins (children of Gloria Bongalon Colasito and Anastacio Bongalon) wanted some help on what we are supposed to do to claim our inheritance legally.

Our relatives are claiming these properties illegally right now and we want to solve this problem as soon as possible.

I would like to know more about the rent act law. I had rented a house for 3,500/mo from Nov 2009 to Dec 2010 with a 1 year contract.
Stated on the contract the 2 months deposit or the 1 month advance deposit cannot be applied for any unpaid rent. That the lessor is not responsible for a) presence of bugs, vermin, ants, termites, and other insects, if any, in the leased premises; b) for the failure of electric current and/or water services; and c) for any injury, loss or damage which the lessee might sustain in the leased premises due to any cause whatsoever.
DOes the lessor has the right to impose 10% penalty for late payments?
I would surely appreciate it if you can answer my questions. My landlord doesn't want to return the extra money. He's charging me for the improvements made in the house.

Dairo succeeded as Municipal Mayor an being the highest ranking SB member, I succeeded as Municipal Vice Mayor.( With OATH of office) In 2007 I again ran and won as SB member. (with OATH of office) The same in 2010 election, I again ran and won SB member of the said Municipality.(with OATH of office) Am I still qualified to ran as SB member this coming Local National Election 2013?? Thanks for your website, I am not any lawyer but reading law materials for my own research in connection with my legal affairs, like the following subject below:

Subject: Adverse claim slapped by a daughter on her father covering the TCT land of the father.

I have four questions:

1. How easy and quick can an adverse claim be cancelled?

2. I have heard that an adverse claim was cancelled without any party of interest having to go to court and get a judge to cancel it, is that possible and actually being done like as a routine?

3. What is the role of the sheriff in the regional trial court branches of a city in getting an adverse claim cancelled?

4. I have a TCT and my daughter slapped an adverse claim against me on it, to stop me from selling the land covered by this TCT; I read that an adverse claim does not stop the owner of the TCT land from selling it to a willing buyer, which buyer will assume all the whatever troubles the adverse claimant will make against the old owner or new owner of the TCT covered land, is that correct - and also troubles from whatever else third parties with any interest or right over the land?

I am Jesus Carmelo E. Arguelles. I am writing, first of all, to indicate that I am a big fan of your Virtual Law Library. It helped me a lot in my business and law-related studies back in college. The site is actually helping me until now.

Law and history are among my favorite subjects. This fact, combined with my current jobs as writer and researcher, have prompted me to make some suggestions regarding your Virtual Law Library, if that's okay with you.

In one of my work-related tasks, I visited your site and noticed something about RA 10699 and RA 9064. Despite the fact that "10699" repeals the other RA, there is still a page for RA 9064. The existence of a webpage for "9064," however, is not my concern. On that page for "9064," there is no indication that it is no longer an active law. Therefore, perhaps if your IT staff or other employees can find time to add a "status" feature for each webpage for each republic act, that would be helpful for a lot of people. For a example, for the webpage for RA 9064, you could add the words "Status: Repealed by RA 10699," and perhaps link that page to "10699." It would be wonderful if, for example, any pair of webpages like Webpage A and Webpage B (where A is a republic act, and B is another) could have links with each other if one of the two repeals, amends, or is related to the other in one way or another.

Aside from this, it would be great if there is an index page for your Virtual Law Library, similar to a book index. Like for example, the word "Sports" in that index would open a webpage containing a list of republic acts, among which is RA 10699. This is especially helpful for people like physical education teachers, who sometimes research the legal bases for topics related to their lessons, such as sports. I have seen first hand a case recently where a teacher needed this kind of information.

I am making these suggestions because I love your site so much and would want more people to be able to visit it. Creating an index of topics, adding the "status" feature, and interlinking related republic acts (or even Supreme Court rulings, if you desire) may further increase your site's visitors and perhaps, expose your law firm to more potential clients.

In fact, I am highly interested in creating an index of topics, I am willing to work on a project basis for you if you want (work-from-home, if you are willing). I would read some of the republic acts, and create keywords (such as sports, transportation, budget, finance, banking, social security, agriculture) related to the said laws. I could even take notes which republic acts are related to each other to help in the interlinking of separate republic acts.
